1. Purpose
These terms govern distance sales of hand embroidered cushions between
SHIKI Broderies and any person not acting for business purposes. Placing an order
implies their acceptance.
2. The pieces
The cushions are embroidered by hand, piece by piece. Assembly is done by
machine; the embroidery is manual. The photographs show the pieces as faithfully as
possible: slight variations in shade, material or dimension are inherent to
handwork and do not constitute a defect.
Each page states the dimensions, the material, the stitches used and the
working time.
3. Orders
An order is formed by an exchange of emails constituting agreement on the
item and the price. The workshop confirms in writing and states the making time. As
each piece is made by hand, timings are indicative and given piece by piece.
4. Prices and payment
Prices are stated in euros, excluding delivery. Delivery charges are given
before the order is concluded.

The risk of loss or damage passes to the buyer when the buyer, or a third
party designated by the buyer, takes physical possession of the goods.
6. Right of withdrawal
The buyer has fourteen days in which to exercise the right of withdrawal,
without having to give reasons. This period runs from receipt of the goods by the
buyer or by a third party, other than the carrier, designated by the buyer
(article L. 221-18 of the French Consumer Code).
Personalised pieces. Under article L. 221-28, 3°, of the French Consumer Code, the right of
withdrawal cannot be exercised for goods made to the buyer's specifications or
clearly personalised. Bespoke orders are therefore excluded: choice of motif,
colours, dimensions or any other requested specification.
This is restated before any bespoke order and in the confirmation
email.
For available, non personalised pieces the right applies normally: the
buyer returns the goods at their own cost within fourteen days of the decision, in
their original condition.
7. Legal guarantees
The buyer has the benefit of the legal guarantee of conformity (articles
L. 217-3 et seq. of the French Consumer Code) and of the guarantee against hidden
defects (articles 1641 et seq. of the French Civil Code), independently of any
commercial warranty.
8. Complaints
Any complaint should be sent to isabel@shiki-broderies.com. Failing an
amicable solution, the buyer may refer the matter free of charge to the consumer
mediator named in the legal notice.
9. Governing law
These terms are governed by French law. A consumer residing in another
European Union State retains the benefit of the mandatory provisions of the country
of their habitual residence.
